We are all against judicial activism now

I thought this interview with Senator Ben Nelson (D-Nebraska, and member Gang of 14) was interesting because he put any possible objections he would have to Justice-nominee Alito in terms of fears that he might be a "judicial activist." A judicial activist would unsettle settled law, such as Roe v. Wade, in his view. Does anyone want to publically defend judicial activism anymore? Only those outside the mainstream, perhaps.
